Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using any FrostWeb Studios service -- including but not limited to frostweb.studio, identity.frostweb.studio, forums.frostweb.studio, our game servers, companion applications, and any associated APIs -- you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you must immediately discontinue use of all FrostWeb services.

You must be at least thirteen (13) years of age to create an account or use FrostWeb services. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. We do not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will promptly terminate their account and delete associated data.

These Terms apply in addition to any game-specific rules, community guidelines, or supplemental terms that may be presented to you in connection with particular FrostWeb services. In the event of a conflict between these Terms and any game-specific rules, these Terms shall control unless the game-specific rules expressly state otherwise.

2. Description of Services

FrostWeb Studios develops, publishes, and operates a variety of interactive entertainment services and related platforms. Our current and planned offerings include, but are not limited to, the following:

• Ayndora -- A fantasy massively multiplayer online role-playing game (MMORPG) set in a rich, dark fantasy world. Ayndora features persistent characters, guilds, real-time combat, crafting systems, player-driven economies, and ongoing content updates.
• Murica AF -- A tactical team-based first-person shooter featuring competitive multiplayer modes, ranked matchmaking, seasonal content, and community-driven events.
• FrostWeb Identity -- A centralized account management system that provides single sign-on (SSO) authentication across all FrostWeb services, including account creation, profile management, security settings, and third-party account linking.
• FrostLauncher -- A desktop application that serves as the primary game launcher and updater for FrostWeb titles, providing game installation, patching, news feeds, and quick access to FrostWeb services.
• Community Forums -- Hosted at forums.frostweb.studio, our forums provide a space for players to discuss games, share content, report bugs, provide feedback, and engage with the FrostWeb community and development team.
• Companion Mobile Applications -- Mobile apps that provide supplementary access to game features such as character management, guild communication, inventory browsing, skill planning, and in-game chat.
• Related Websites & Services -- Any additional websites, microsites, APIs, and web-based tools operated by FrostWeb Studios in support of the above services.

FrostWeb reserves the right to modify, suspend, or discontinue any service or feature at any time, with or without notice. We continually evolve our offerings to improve the player experience, and certain services may be added, altered, or retired as part of this ongoing development process.

3. Account Registration & Security

To access most FrostWeb services, you must register for a FrostWeb Identity account. Each individual is permitted to maintain only one (1) FrostWeb Identity account. Creating multiple accounts to circumvent bans, exploit promotions, manipulate game systems, or for any other purpose is strictly prohibited and may result in the termination of all associated accounts.

When registering, you must provide accurate, current, and complete information. You agree to keep your account information up to date. Providing false, misleading, or fraudulent information during registration or at any time thereafter is a violation of these Terms and may result in immediate account termination.

You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password. You agree to:

• Choose a strong, unique password that you do not use for any other service.
• Enable multi-factor authentication (MFA) when available, which is strongly recommended for all accounts.
• Never share your account credentials with any other person.
• Immediately notify FrostWeb at [email protected] if you suspect any unauthorized access to or use of your account.

FrostWeb Identity supports linking third-party accounts, including Google, Steam, and Epic Games, to enhance your experience and simplify authentication. Linking a third-party account is optional and subject to the third party's own terms and privacy policies. You may unlink third-party accounts at any time through your account settings. Display name changes are limited to once every thirty (30) days to maintain community stability and prevent abuse.

4. User Conduct

FrostWeb Studios is committed to maintaining a safe, fair, and enjoyable environment for all users. You agree that your use of FrostWeb services will comply with these Terms, all applicable laws, and any community guidelines or codes of conduct published by FrostWeb. The following rules of conduct apply across all FrostWeb platforms, including games, forums, chat systems, companion apps, and any other FrostWeb service.

You agree that you will NOT:

• Cheat, hack, or exploit: Use, develop, distribute, or promote cheats, automation software (bots), hacks, mods not expressly authorized by FrostWeb, or any other unauthorized third-party software that interacts with FrostWeb services. This includes exploiting bugs, glitches, or unintended game mechanics for personal advantage. If you discover an exploit or vulnerability, you are expected to report it to FrostWeb promptly.
• Harass or engage in hate speech: Engage in harassment, bullying, threats, stalking, or any form of abusive behavior toward other users. This includes hate speech, slurs, or discriminatory language based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
• Impersonate others: Impersonate any person or entity, including FrostWeb employees, moderators, or other players, or falsely represent your affiliation with any person or entity.
• Engage in unauthorized commercial activity: Sell, trade, transfer, or offer to sell or trade FrostWeb accounts, in-game items, currency, or any other service-related assets for real-world money or value, except through mechanisms expressly provided by FrostWeb. Advertising, soliciting, or spamming within FrostWeb services is prohibited.
• Disrupt services: Take any action that imposes an unreasonable or disproportionately large load on FrostWeb infrastructure, or attempt to disrupt, degrade, or interfere with the normal operation of any FrostWeb service. This includes denial-of-service attacks, packet flooding, or any form of network-level disruption.
• Reverse engineer: Decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code, underlying algorithms, or data structures of any FrostWeb software, service, or protocol, except to the extent expressly permitted by applicable law notwithstanding this limitation.

Violations of these conduct rules may result in warnings, temporary suspensions, permanent account termination, or other actions at FrostWeb's sole discretion. The severity and duration of any enforcement action will be determined based on the nature of the violation, the user's history, and other relevant factors. FrostWeb reserves the right to investigate and take appropriate action without prior notice.

5. Intellectual Property

All content, materials, and intellectual property associated with FrostWeb services -- including but not limited to game software, artwork, graphics, character designs, world lore, music, sound effects, animations, user interface designs, logos, trademarks, trade names, and documentation -- are owned by or licensed to FrostWeb Studios and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms, FrostWeb grants you a limited, non-exclusive, non-transferable, revocable license to access and use FrostWeb services for your personal, non-commercial entertainment purposes. This license does not include the right to: (a) modify, copy, distribute, or create derivative works based on FrostWeb content; (b) use FrostWeb content for any commercial purpose; (c) use data mining, robots, or similar data gathering or extraction methods on FrostWeb services; or (d) download, store, or cache any FrostWeb content except as expressly permitted by the services (e.g., normal game client caching).

With respect to user-generated content ("UGC") -- including but not limited to forum posts, screenshots, fan art, character names, guild names, chat messages, and any other content you create or submit through FrostWeb services -- you retain ownership of your original content. However, by submitting UGC to FrostWeb services, you grant FrostWeb a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from your UGC in connection with operating and promoting FrostWeb services. This license survives termination of your account with respect to UGC that has been shared publicly or incorporated into the services.

FrostWeb respects the intellectual property rights of others. If you believe that any content on FrostWeb services infringes your copyright, please contact us at [email protected] with a detailed description of the alleged infringement, consistent with the requirements of the Digital Millennium Copyright Act (DMCA).

6. Virtual Items & In-Game Currency

FrostWeb services may offer virtual items, virtual currency, cosmetic items, experience boosts, and other digital goods (collectively, "Virtual Items") that can be acquired through gameplay, promotional events, or purchase. You acknowledge and agree that Virtual Items are licensed to you under a limited, personal, non-transferable, non-exclusive, revocable license, and are not sold to you. You do not own Virtual Items -- you have a limited right to use them within the applicable FrostWeb service, subject to these Terms.

Virtual Items have no real-world monetary value and cannot be redeemed for cash, credit, or any form of real-world currency. Virtual Items are not property and cannot be inherited, transferred outside of in-game systems, or treated as an asset in any legal proceeding. Any prices or values displayed for Virtual Items within FrostWeb services reflect only the cost of the license granted and do not establish a real-world market value.

FrostWeb reserves the right to manage, regulate, modify, or remove Virtual Items and virtual economies at any time, for any reason, without notice or liability. This includes the right to adjust drop rates, pricing, availability, functionality, or appearance of any Virtual Items. Such changes may be made for game balance, economic health, content updates, or any other reason FrostWeb deems appropriate.

Real-money trading ("RMT") of Virtual Items is strictly prohibited. You may not buy, sell, gift, trade, or transfer Virtual Items, in-game currency, or accounts to or from any third party for real-world money, goods, or services, except through mechanisms expressly provided and authorized by FrostWeb within its services. Engaging in or facilitating RMT will result in immediate account termination and may subject you to legal action.

7. Privacy

Your privacy is important to FrostWeb Studios. Our collection, use, storage, and disclosure of your personal information is governed by our Privacy Policy, available at https://frostweb.studio/privacy. The Privacy Policy is incorporated into these Terms by reference, and by agreeing to these Terms, you also agree to the practices described in the Privacy Policy.

FrostWeb handles all personal data in compliance with applicable Florida state laws, including the Florida Digital Bill of Rights (FDBR), as well as applicable federal regulations. We implement industry-standard security measures to protect your data, including encryption of data in transit and at rest, secure authentication protocols, and regular security audits. However, no method of electronic storage or transmission is perfectly secure, and we cannot guarantee absolute security.

By using FrostWeb services, you consent to the collection and processing of certain data necessary for providing the services, including but not limited to: account information, gameplay data, device information, usage analytics, and communication data. For complete details on what data we collect, how we use it, your rights regarding your data, and how to exercise those rights, please refer to our Privacy Policy.

8. Termination & Suspension

FrostWeb reserves the right to suspend, restrict, or terminate your account and access to any or all FrostWeb services at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, violation of game-specific rules or community guidelines, suspected fraudulent or illegal activity, extended periods of inactivity, or at FrostWeb's sole discretion to protect the integrity and safety of our services and community.

As a security measure, your account may be temporarily locked after multiple consecutive failed login attempts. Locked accounts can be recovered through our account recovery process, which may require identity verification. FrostWeb implements these security measures to protect your account from unauthorized access and brute-force attacks.

You may request deletion of your FrostWeb Identity account at any time by contacting our support team or through your account settings. Upon receiving a valid deletion request, FrostWeb will process the deletion in accordance with our Privacy Policy and applicable data retention requirements. Please note that account deletion is permanent and irreversible -- all associated game characters, progress, Virtual Items, forum posts, and other account-related data will be permanently removed, except where retention is required by law.

Upon termination or suspension of your account for any reason, your license to access and use FrostWeb services is immediately revoked. You will lose access to all Virtual Items, in-game progress, and other account-associated content. FrostWeb shall have no obligation to provide refunds, compensation, or restoration of any kind upon account termination, except where required by applicable law.

9. Disclaimers

FROSTWEB SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FROSTWEB STUDIOS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FrostWeb does not warrant that the services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Online games and services require regular maintenance, updates, and patches. FrostWeb may schedule planned maintenance windows during which services will be temporarily unavailable, and unplanned outages may occur due to technical issues, server problems, or circumstances beyond our control. FrostWeb will make reasonable efforts to minimize disruption and communicate scheduled maintenance in advance, but makes no guarantees regarding uptime or availability.

Certain FrostWeb services or features may be designated as "beta," "early access," "preview," or similar labels indicating that they are in a pre-release or testing phase. Such features are provided for testing and feedback purposes and may be incomplete, contain bugs, cause crashes, result in data loss, or otherwise not function as intended. By using beta features, you accept these additional risks and acknowledge that beta features may be modified or removed at any time without notice.

FrostWeb makes no representations or warranties regarding the accuracy, reliability, or completeness of any content available through FrostWeb services, including user-generated content and third-party content. Any reliance on such content is at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FROSTWEB STUDIOS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) FROSTWEB SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF FROSTWEB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF FROSTWEB STUDIOS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF FROSTWEB SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO FROSTWEB IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

The limitations of liability set forth in this section shall not apply to liability arising from FrostWeb's gross negligence or willful misconduct, or to any liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, FrostWeb's liability will be limited to the fullest extent permitted by applicable law.

11. Governing Law & Disputes

These Terms and any dispute arising out of or relating to these Terms or FrostWeb services shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of FrostWeb services that cannot be resolved through informal negotiation within thirty (30) days of written notice shall be resolved through final and binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Florida, and the arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and attorney's fees, unless the arbitrator determines that a claim was frivolous, in which case the arbitrator may award costs and fees to the prevailing party.

Class Action Waiver: YOU AND FROSTWEB AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and FrostWeb agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.

Small Claims Court Exception: Notwithstanding the foregoing arbitration provision, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court. Additionally, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

12. Changes to Terms

FrostWeb Studios reserves the right to modify, amend, or update these Terms of Service at any time. When we make changes, we will update the "Effective Date" at the top of this page to reflect the date the revised Terms take effect. We encourage you to periodically review these Terms to stay informed of any updates.

For material changes -- those that significantly affect your rights or obligations under these Terms -- FrostWeb will provide advance notice through one or more of the following methods: email notification to the address associated with your FrostWeb Identity account, prominent in-service notices or banners, notifications through FrostLauncher, or announcements on our community forums. Material changes will typically take effect no sooner than thirty (30) days after such notice is provided, unless a shorter period is required by law or necessary to address security concerns.

Your continued use of FrostWeb services after the effective date of any revised Terms constitutes your acceptance of and agreement to the updated Terms. If you do not agree to the revised Terms, you must stop using FrostWeb services and may request deletion of your account. It is your responsibility to ensure that the email address associated with your account is current and monitored, so that you receive any notifications regarding changes to these Terms.
